IN CONSIDERATION OF THE COVENANTS and agreements contained in this Sales Agreement the parties to this agreement agree as follows:
1. The Seller reserves the right to cancel or leave any event without refund for the following reasons:
a. The safety or comfort of a performer or team member has been threatened
b. There is behavior that could be potentially damaging to company property (costumes, wigs, party favors, etc.) such as smoking at the party location while our characters are present, children attempting to damage company property, etc.
c. There is potentially damaging or dangerous weather (or the ground is saturated from previous rain) and the Buyer has not provided an indoor location
d. Any of the information the Buyer has provided is falsified
e. There is no parent or guardian present at the event to supervise children and party guests
f. Another character company is in attendance (potentially compromising character integrity) that we have not been made aware of
g. The buyer has not gotten permission for our performers or team members to enter the location
2. The Buyer acknowledges that photos taken at their event may be used for advertising purposes (unless requested otherwise by the Buyer in an email)
3. Coastal Events & Character Parties and it’s owners, operators, and performers assume no liability for any accidents or allergies. As the client, you assume all responsibility and liability for all guests.
4. Coastal Characters will never share any information that you provide us except to complete our services
5. The Buyer agrees that deposits are non-refundable, unless Coastal Characters cancels for any reason other than those listed above
